2 children dead in Englewood fire, 2 others rescued

A young boy and girl died this morning in a fire in the Englewood neighborhood, officials say.









A young boy and girl died this morning after they and two other children were left home alone in the Englewood neighborhood on the South Side, officials say.

The girl, 2, and the boy, 3, were found in a back bedroom after firefighters cut through burglar bars on the brick and stone two-flat in the 6400 block of South Paulina Street.


"Please, sergeant, please," a relative pleaded with an officer outside the home. "They're 2 and 3 years old."


A hot plate being used for heat sparked the fire while the four children, alone in the apartment, slept in two bedrooms, according to fire officials. Police said the children's mother and aunt were being questioned.








The surviving children, a 7-year-old boy and his 4-year-old brother, were rescued by an aunt and interviewed by investigators at a neighbor's home.


Darnell, 7, said he and Marquis, 4, had fallen asleep watching Batman cartoons. The two other children -- his 2-year-old sister and 3-year-old cousin -- were asleep in another bedroom. When he woke up, the fire was already burning.

"When the fire started, everything shut off," Darnell said.


The boy said he and Marquis were in a bedroom by the kitchen and "the fire was in the front room where the couch is at. When we saw the fire, it was like in the front room, then it was by the bathroom door."

Darnell said his aunt came rushing through the front door. "When (she) saw the fire, she called all our names. When I opened the door, she told me, 'Come on, the fire's getting closer.' I coughed, my auntie was choking. My sister was banging on the door.

"When we got outside, police passed us, then drove backward and came up because there was a fire," he said.

Darnell's sister died in the fire, along with his cousin.

Darnell and Marquis were brought to a neighbor's house, where investigators from the Bomb and Arson unit and the Office of Fire Investigations (OFI) talked to them.

The investigator from OFI squatted down while talking to the boys. Only Darnell spoke. Marquis was quiet the entire time. Darnell spoke to a Tribune reporter afterward as he sat with four neighbors in their home.


The children were later taken into protective custody by the Department of Children and Family Services.


When firefighters arrived around 3:30 a.m., they weren't able to get into the home because of intense heat and fire, a Fire Department official said. Fire was heavy throughout the basement and first floor, he said.


Firefighters cut through burglar bars on the windows, he said.


The basement windows were all shattered. A white Christmas tree, smudged with smoke, stood near front room window. 


A neighbor told an investigator that the second-floor tenants recently moved out of the brick and stone two-flat.

Ridley Scott, Paul Attanasio Working on “Vatican” Pilot for Showtime






LOS ANGELES (TheWrap.com) – Showtime is once again preparing to go papal.


The network, which already has a Pope-centric hit in the form of “The Borgias,” has given the green light to pilot tentatively titled “The Vatican,” from Ridley Scott and Paul Attanasio, Showtime said Thursday.






A contemporary exploration of the politics and power plays within the Catholic church, “The Vatican” will be written by Attanasio and directed by Scott, marking the first pilot that Scott has directed.


“The Vatican” is described as “a provocative contemporary genre thriller about spirituality, power and politics – set against the modern-day political machinations within the Catholic church” that will “explore the relationships and rivalries as well as the mysteries and miracles behind one of the world’s most hidden institutions.”


Production on “The Vatican,” which is being produced by Sony Pictures Television in association with Showtime, will begin next year.

Alabama to End Isolation of Inmates With H.I.V.

A federal judge on Friday ordered Alabama to stop isolating prisoners with H.I.V.




Alabama is one of two states, along with South Carolina, where H.I.V.-positive inmates are housed in separate prisons, away from other inmates, in an attempt to reduce medical costs and stop the spread of the virus, which causes AIDS.


Judge Myron H. Thompson of the Middle District of Alabama ruled in favor of a group of inmates who argued in a class-action lawsuit that they had been stigmatized and denied equal access to educational programs. The judge called the state’s policy “an unnecessary tool for preventing the transmission of H.I.V.” but “an effective one for humiliating and isolating prisoners living with the disease.”


After the AIDS epidemic of the 1980s, many states, including New York, quarantined H.I.V.-positive prisoners to prevent the virus from spreading through sexual contact or through blood when inmates tattooed one another. But most states ended the practice voluntarily as powerful antiretroviral drugs reduced the risk of transmission.


In Alabama, inmates are tested for H.I.V. when they enter prison. About 250 of the state’s 26,400 inmates have tested positive. They are housed in special dormitories at two prisons: one for men and one for women. No inmates have developed AIDS, the state says.


H.I.V.-positive inmates are treated differently from those with other viruses like hepatitis B and C, which are far more infectious, according to the World Health Organization. Inmates with H.I.V. are barred from eating in the cafeteria, working around food, enrolling in certain educational programs or transferring to prisons near their families.


Prisoners have been trying to overturn the policy for more than two decades. In 1995, a federal court upheld Alabama’s policy. Inmates filed the latest lawsuit last year.


“Today’s decision is historic,” said Margaret Winter, the associate director of the National Prison Project of the American Civil Liberties Union, which represented the inmates. “It spells an end to a segregation policy that has inflicted needless misery on Alabama prisoners with H.I.V. and their families.”


Brian Corbett, a spokesman for the Alabama Department of Corrections, said the state is “not prejudiced against H.I.V.-positive inmates” and has “worked hard over the years to improve their health care, living conditions and their activities.”


“We will continue our review of the court’s opinion and determine our next course of action in a timely manner,” he wrote.


During a monthlong trial in September, lawyers for the department argued that the policy improved the treatment of H.I.V.-positive inmates. Fewer doctors are needed if specialists in H.I.V. focus on 2 of the 29 state’s prisons.


The state spends an average of $22,000 per year on treating individual H.I.V.-positive inmates. The total is more than the cost of medicine for all other inmates, said Bill Lunsford, a lawyer for the Corrections Department.


South Carolina has also faced legal scrutiny. In 2010, the Justice Department notified the state that it was investigating the policy and might sue to overturn it.

Emanuel explores Midway privatization









Mayor Rahm Emanuel's administration will explore the possibility of privatizing Midway Airport but will take a shorter-term, more tightly controlled approach than was employed by former Mayor Richard Daley's team on the city's first go-round.

Chicago's last try, a 99-year lease that would have brought in $2.5 billion, died in 2009 when the financial markets froze up.

The city's latest intentions are expected to be formally announced Friday, ahead of a Dec. 31 deadline for deciding whether to retain a slot for Midway in the Federal Aviation Administration's airport privatization pilot program. The city put off this decision several times previously.

The move, preliminary as it is, is sure to be politically charged, given the anger over the way Daley's 75-year parking meter privatization deal has played out, with proceeds used to plug operating deficits and meter rates rising sharply.

With that historical backdrop, Emanuel is suggesting a more conservative approach. It includes a shorter-term lease of less than 40 years; a "travelers' bill of rights" aimed at ensuring any changes will benefit passengers; and a continuing stream of revenue for the city, giving it a shot to capture some growth.

And unlike the parking meter and Chicago Skyway lease deals, a new Midway transaction would not allow proceeds to be used to plug operating deficits or to pay for operations in any way, Emanuel said in an interview Thursday.

"I will not let the city use it as a crutch to not make the tough decisions on the budget," he said.

But while a shorter lease and greater city control may play well locally, those sorts of terms may not appeal to investors, experts said in interviews this month.

"The shorter the lease term, the lower the bid prices are going to be — that's just the math," said Steve Steckler, chairman of the Infrastructure Management Group, a Bethesda, Md.-based company that advises infrastructure owners and operators. "I'd be shocked if investors offered more than $2 billion for a 40-year lease," Steckler said.

Emanuel said: "Nobody knows until you talk to people. … I'm the mayor and I'm not agreeing to … 99 years. I'm saying it's either 40 years or less." His office has not offered an estimate of what such a deal could bring in, saying it would be premature.

"No final decisions have been made, but we can't make a decision until we evaluate fully if this could be a win for Chicagoans," Emanuel said.

A private operator would take over management of such revenue-producing activities as food, beverage and car rental concessions and parking lots. The FAA would continue to provide air traffic control, while the Transportation Security Administration would continue to provide security operations. The city would retain ownership.

Few details were provided about how privatization would affect travelers and Midway employees. Emanuel said specifics will emerge over time.

By year's end, the city will send the FAA a preliminary application, a timetable and a draft "request for qualification," a document the city will put out early next year to identify qualified bidders for the project. A review of the potential bidders will be conducted in the spring.

Last year, Emanuel expressed hesitation in pursuing a private lease for Midway unless a careful vetting process was in place, saying taxpayers were correct to be wary, given the city's history.

The evaluation process will be deliberate and open to public view, he said Thursday.

He pledged to create a committee of business, labor and civic leaders that will provide updates to the public on a regular basis and that will select an independent adviser to vet the transaction. The committee will deliver a report to the City Council, and there will be a 30-day review period before any vote.

"I set up a different process and a different set of principles that stand in stark contrast to what was discussed or done in the past," Emanuel said.

The FAA pilot program frees cities from regulations that require airport revenue to be used for airport purposes. It allows money to be withdrawn for other uses.

Bank robber caught 2 days after bed sheet jailbreak

Police entered ahomein Southwest suburban Tinley Park about 11:30 Tuesday morning, searching for two escaped prisoners.









Police cars swarmed a block on the North Side overnight and arrested one of the two bank robbers who escaped out the window of the federal jail in the South Loop earlier this week, officials said.


Joseph "Jose" Banks was taken into custody by FBI agents and Chicago police around 11:30 p.m. Thursday in the 2300 block of North Bosworth Avenue, according to the FBI.


A young man and a woman who left the building about an hour after the arrest declined to talk.
“We’re not in the mood to answer any questions,” the man said.








Colm Marron said he stepped out of a bar on Fullerton Avenue and saw about a half-dozen unmarked police cars gathering in the Walgreens parking lot around the corner from the building. “They flew out, just down there,” he said, motioning from inside the bar toward Bosworth Avenue.


Seconds later he heard a “huge bang.”


“I was surprised how loud the bang was. It wasn’t like any thunder I’ve ever heard,” he said. “There wasn’t any echo to it, just that loud, off the bat.”


A few minutes later, a handful of marked Chicago police cars arrived, he said.


At a BP gas station at Fullerton, Clybourn and Ashland avenues, an attendant working the overnight shift said he saw two Chicago police cars – an SUV and a squadrol – with an unmarked car in the front and back.


“It’s not like there was a big old mob out there looking,” said Ralph De LaRosa, 45. 


He noticed the flashing lights while he stood inside the gas station.


The police cars, their lights flashing, took off west on Fullerton, then south on Ashland.


Banks and his cellmate, Kenneth Conley, both convicted bank robbers awaiting sentencing, were last accounted for at 10 p.m. Monday during a routine bed check at the Metropolitan Correctional Center, authorities said.


About 7 a.m. Tuesday, jail employees arriving for work saw ropes made from bedsheets dangling from a hole in the wall near the 15th floor. The two had put clothing and sheets under blankets in their beds to throw off guards making nighttime checks, authorities said.


Cameras mounted to the side of the 28-story federal jail captured Banks and Conley sliding down the building shortly after 2:30 a.m. Tuesday, according to an employee who wished to remain anonymous.


The men left view briefly, but it was believed they landed on the roof of a garage below. Moments later, footage from a different camera showed them hopping a black fence marking the perimeter of the property, the employee said.


The FBI said a surveillance camera a few blocks from the jail showed the men, wearing light-colored clothing, hailing a taxi at Congress Parkway and Michigan Avenue. They also appeared to be wearing backpacks, according to the FBI.


The manhunt for the inmates included several high-profile raids Tuesday in the southwest suburbs of Tinley Park and New Lenox, where Conley's family and associates lived. Conley is still unaccounted for as of Friday morning.


A $50,000 reward for information leading to the capture of the two fugitives was announced by the FBI.

Nokia to get payments in patent deal with RIM






HELSINKI (Reuters) – Struggling Finnish mobile phone maker Nokia has settled its patent dispute with BlackBerry maker Research in Motion in return for payments, as it tries to exploit its trove of technology patents to boost its finances.


Terms of the agreement were confidential, but Nokia said on Friday it included a one-time payment to be booked in the fourth quarter, as well as ongoing fees, all to be paid by RIM.






Nokia is one of the industry’s top patent holders, having invested 45 billion euros ($ 60 billion) in mobile research and development over the past two decades.


It has been trying to make use of that legacy to ensure its survival, amid a fall in sales as well as cash. The Finnish firm is battling to recover lost ground in the lucrative smartphone market to the likes of Apple and Samsung.


The agreement with RIM settles all existing patent litigation between the two companies, Nokia said, adding similar disputes with HTC Corp and ViewSonic still stood.


“This agreement demonstrates Nokia’s industry leading patent portfolio and enables us to focus on further licensing opportunities in the mobile communications market,” said Paul Melin, Nokia’s chief intellectual property officer.


Nokia has earned around 500 million euros a year from patent royalties in key areas of mobile telephony.


Some analysts have said it could earn hundreds of millions more if it can negotiate with more companies successfully.


Analysts estimated its June 2011 settlement with Apple was worth hundreds of millions of euros.

‘Zero Dark Thirty’ One of Biggest Mid-Week Limited Debuts Ever






LOS ANGELES (TheWrap.com) – “Zero Dark Thirty” has been slammed by several senators for its depiction of torture, but the issue only appears to have helped it at the box office.


Director Kathryn Bigelow‘s dramatization of the hunt for Osama Bin Laden racked up an estimated $ 124,848 in five theaters in New York City and Los Angeles on Wednesday. That’s an average of $ 24,969, making it one of the biggest limited mid-week openings in history.






Other Oscar-bait films in limited release scored far less in their debuts. “American Beauty” grossed $ 73,000 in 6 theaters and “Little Miss Sunshine” grossed $ 66,000 in 7 showings on their opening days.


The film arrives in theaters boasting four Golden Globe nods, including a nomination for Best Motion Picture – Drama, and a boatload of strong reviews.


In Slate, Dana Stevens praised the film for its unflinching depiction of the global manhunt.


“Zero Dark Thirty, as single-minded and emotionally remote as its heroine, plays its cards so close to its vest that it’s impossible to tell,” Stevens wrote. “But this is a vital, disturbing, and necessary film precisely because it wades straight into the swamp of our national trauma about the war on terror and our prosecution of it, and no one – either on the screen or seated in front of it – comes out clean.”


Not everyone has loved “Zero Dark Thirty”s’ moral ambiguity, however. Senators John McCain, Dianne Feinstein and Carl Levin have criticized the film for seeming to argue that torture helped the CIA locate bin Laden.


In a letter to Sony Pictures chairman and CEO Michael Lynton, the senators said that the studio should state that the film is a work of fiction and its depiction of torture’s role in the operation to find bin Laden is fictitious.


In a statement provided to TheWrap, Bigelow and screenwriter Mark Boal said critics were taking the torture scene out context.


“This was a 10-year intelligence operation brought to the screen in a two-and-a-half-hour film. We depicted a variety of controversial practices and intelligence methods that were used in the name of finding bin Laden,” the statement reads. “The film shows that no single method was necessarily responsible for solving the manhunt, nor can any single scene taken in isolation fairly capture the totality of efforts the film dramatizes.”


“Zero Dark Thirty” stars Jessica Chastain, Joel Edgerton and Chris Pine. It opens in wide release on January 11.

Theater review: Hilarious, hometown 'Book of Mormon'









Most of the audience flocking to “The Book of Mormon,” which officially descended on Chicago Wednesday night like satirical manna from some warped “South Park” heaven, are looking for amusement and escape. They'll surely find salvation from the rough old world in this new production of the deliciously over-eager 2011 Broadway hit, newly crafted for Chicago with a clutch of utterly committed, fresh-faced, faux-Mormon lads.

The true revelation in this brand new Chicago production — directed by Casey Nicholaw and Trey Parker and that stands up well to the original Broadway edition — is one Ben Platt, a hilariously funny young actor who finds an entirely different way into Elder Cunningham, the loser-geek Mormon, first played in New York by Josh Gad. He is the partner on this mission to Uganda for the alpha Elder Price (Nic Rouleau, who comes direct from Broadway and is also sharp and generally terrific, although very much in the original mold of the role). Platt, whose comic instincts are exquisite, really leans into this part, throwing himself out there with the abandonment of youth and shrewdly pushing the sincerity and charm of the character while downplaying the obvious manifestation of his quirks. Physical resemblance notwithstanding, Platt kicks the dangerous Jonah Hill-like cliches half way to Christendom, and makes the sidekick role about four times as funny and ten times as believable. He's no “American Idol” vocalist, but you won't care.




Laughs flow like Mormon wagon trains rolling West. But “The Book of Mormon,” like the enigmatic volume it lampoons so mercilessly, is actually a many-layered beast and therein, verily, lies its brilliance.

I'll try and not spoil narrative surprises. Somehow, the writing and composing team of Trey Parker, Robert Lopez and Matt Stone managed to poke wicked fun at the all-American religion without frying on the third rail of religious faith — and all the while convincing their audience that they actually are enjoying a rather sweet show.

“The Book of Mormon” is exquisitely toned. It brilliantly exploits the protection afforded by edges and extremes and mitigates its use of gags about such comedic untouchables as Jesus Christ, AIDS, Africa and genital mutilation (and those are the printable topics) with an earnestness impossible for even a nervous prude to resist. On Wednesday, those prudes were sputtering into their shirt collars with mirth.

In terms of risky content, “The Book of Mormon” makes the Monty Python boys look like they were writing the Acts of the Apostles. Yet it has a sweetness that few other satirical dramatic works have achieved. These Mormons are so lovable you feel half-inclined to take a couple of ‘em home with you. (It’s not like anyone ever wanted to give Mel Brooks a hug.)

Thanks mostly to Lopez, the show not only has a strikingly traditional and whip-tight musical structure; fans of the genre will recognize little stylistic spoofs of “Defying Gravity” from “Wicked,” “Tomorrow” from “Annie” and, of course, the hilarious Act 2 centerpiece wherein earnest Ugandans mangle Mormon doctrine in a skewering of “The Small House of Uncle Thomas” from “The King and I.” Jesus also looks remarkably like Prince Herbert from “Spamalot.”

But for those who hate musicals — and plenty of “South Park” fans are in that category — the caustic, relentless Parker-Stone worldview is very much is in evidence—especially in the truly inspired “spooky Mormon Hell” nightmare sequence centered on Adolf Hitler, Johnnie Cochran (“if it don't fit ..”) and dancing cups of illicit, mock Starbucks. These, they declare, are what keeps the members of the Church of Jesus Christ of Latter-day Saints awake at night. They may well be right. This show steers closer to the truth than you might think.

On a further viewing, I was blown away again by the disciplined narrative logic these writers applied to their outrageous storytelling. That's what comes of creating a TV show from whole imaginative cloth, almost every week for 16 years. One learns how to ensure the outlandish makes perfect sense.

Look behind the gags and you can find much pondering of the central problem faced by all people of faith: the apparent inability of religion to end the suffering of the innocent. You can find discussion of how faith is an all-or-nothing proposition; who could believe about 50 percent of Mormonism? The show lampoons the ability of persons of faith to compartmentalize and, most brilliantly of all, the pervasive nature of racial condescension. Indeed, it's in the racial arena (speaking of third rails) that this show is at its most risky and most admirable, as when white Mormon missionaries sing “We Are Africa” (a dead-on take-down of the smugness of “We Are the World”) even as actual Africans (well, African characters) stare at them in quiet amazement. Chicago actor James Vincent Meredith, who plays Mafala likes he's doing Athol Fugard, is a huge asset to the show.

The one performer who needs work is Syesha Mercado, who plays the lead ingenue role of Nabulungi (her name is constantly bungled as “Neutrogena” and the like by Elder Cunningham). Mercado sings well, albeit at a certain remove, but she has yet to grab hold of the necessary vulnerability of her character and hit the lyrical gags. She was a late replacement and surely will improve with time. Pierce Cassedy, as Elder McKinley (a Mormon who insists on turning off his gay identity) is hilarious and, more importantly, very poignant.

With tickets this scarce and prices this high, you might well wonder if “The Book of Mormon” is worth your time and elevated expectations. Be not afraid, suburban pilgrim. The Chicago production pulses with the just the right combination of Broadway production values, proven material, sufficient buy-in by the original creative team (who all took a bow on opening night) and new young men on a mission, not quite from God.

China’s airing of ‘V for Vendetta’ stuns viewers






BEIJING (AP) — Television audiences across China watched an anarchist antihero rebel against a totalitarian government and persuade the people to rule themselves. Soon the Internet was crackling with quotes of “V for Vendetta‘s” famous line: “People should not be afraid of their governments. Governments should be afraid of their people.”


The airing of the movie Friday night on China Central Television stunned viewers and raised hopes that China is loosening censorship.






“V for Vendetta” never appeared in Chinese theaters, but it is unclear whether it was ever banned. An article on the Communist Party’s People’s Daily website says it was previously prohibited from broadcast, but the spokesman for the agency that approves movies said he was not aware of any ban.


Some commentators and bloggers think the broadcast could be CCTV producers pushing the envelope of censorship, or another sign that the ruling Communist Party‘s newly installed leader, Xi Jinping, is serious about reform.


“Oh God, CCTV unexpectedly put out ‘V for Vendetta.’ I had always believed that film was banned in China!” media commentator Shen Chen wrote on the popular Twitter-like Sina Weibo service, where he has over 350,000 followers.


Zhang Ming, a supervisor at a real estate company, asked on Weibo: “For the first time CCTV-6 aired ‘V for Vendetta,’ what to think, is the reform being deepened?”


The 2005 movie, based on a comic book, is set in an imagined future Britain with a fascist government. The protagonist wears a mask of Guy Fawkes, the 17th-century English rebel who tried to blow up Parliament. The mask has become a revolutionary symbol for young protesters in mostly Western countries, and it also has a cult-like status in China as pirated DVDs are widely available. Some people have used the image of the mask as their profile pictures on Chinese social media sites.


Beijing-based rights activist Hu Jia wrote on Twitter, which is not accessible to most Chinese because of government Internet controls: “This great film couldn’t be any more appropriate for our current situation. Dictators, prisons, secret police, media control, riots, getting rid of ‘heretics’ … fear, evasion, challenging lies, overcoming fear, resistance, overthrowing tyranny … China’s dictators and its citizens also have this relationship.”


China’s authoritarian government strictly controls print media, television and radio. Censors also monitor social media sites including Weibo. Programs have to be approved by the State Administration of Radio, Film and Television, but people with knowledge of the industry say CCTV, the only company with a nationwide broadcast license, is entitled to make its own censorship decisions when showing a foreign movie.


“It is already broadcast. It is no big deal,” said a woman who answered the phone at movie channel CCTV-6. “We also didn’t anticipate such a big reaction.”


The woman, who only gave her surname, Yang, said she would pass on questions to her supervisor, which weren’t answered.


The spokesman for the State Administration of Radio, Film and Television said he had noticed the online reaction to the broadcast. “I’ve not heard of any ban on this movie,” Wu Baoan said Thursday.


The film is available on video-on-demand platforms in China, where movie content also needs to be approved by authorities.


A political scientist at the Chinese Academy of Social Sciences who used to work for CCTV said the film might have approval, or it could have been CCTV’s own decision to broadcast it.


“Every media outlet knows there is a ceiling above their head,” said Liu Shanying. “Sometimes we will work under the ceiling and avoid touching it. But sometimes we have a few brave ones who want to reach that ceiling and even express their discontent over the censor system.


“It is very possible that CCTV decided by itself” to broadcast the film, Liu said. If so, he added, it would have been “due to a gut feeling that China’s film censorship will be loosened or reformed.”


“V for Vendetta” was released in the United States in 2005 and around the world in 2006. China has a yearly quota on the numbers of foreign movies that can be imported on a revenue share basis, making it tough to get distribution approval. Other movies that failed to reach Chinese screens in 2006 include “Brokeback Mountain” and “Pirates of the Caribbean: Dead Man’s Chest.” Chinese moviegoers that year were able to see “Mission: Impossible III” with Tom Cruise and “The Painted Veil,” which was filmed in China and set in a Chinese village.


Warner Brothers, which produced and distributed “V for Vendetta,” declined to comment.


China doesn’t have a classification system, so all movies shown at its cinemas are open to adults and children of any age. A filmmaker and Beijing Film Academy professor, Xie Fei, published an open letter on Sina Weibo on Saturday calling for authorities to replace the movie censorship system that dates from the 1950s with a ratings system.


The airing of “V for Vendetta” raised some hopes about possible changes under Xi, who was publicly named China’s new leader last month. He has already announced a trimmed-down style of leadership, calling on officials to reduce waste and unnecessary meetings and pomp. His reforms are aimed at pleasing a public long frustrated by local corruption.


State media say they have reduced reports on officials’ trips as part of this drive. The official Xinhua News Agency warned this week that media outlets should “learn to play professionally in today’s information age as an increasingly picky audience is constantly” putting them under scrutiny.


An American business consultant and author with high-level Chinese contacts said there is no less commitment to one-party rule in China, so any media reforms will only go so far.


“You can’t have a totally free media as we would have in the West and still maintain the integrity of a one-party system,” said Robert Lawrence Kuhn, who wrote the book “How China’s Leaders Think.” He said he thinks restrictions are being eased, “but it has to be limited.”


The new leadership has to tread carefully, Kuhn said, because in the age of the Internet, talk about reforms won’t be forgotten.


“High expectations, if they are not fulfilled, will create a worse situation,” he said.

Intercontinental to pay $8.2B for NYSE









The IntercontinentalExchange has agreed to buy rival exchange NYSE Euronext for $8.2 billion, as it moves to create one of the top futures markets in Europe and position the combined group to challenge arch rival CME Group.

The two exchanges said in an emailed statement on Thursday ICE had agreed to pay $33.12 a share for NYSE Euronext made up of one third cash and two thirds ICE shares.

The multi-billion dollar deal designed to push it into the big league of European derivatives and take on arch rival CME Group.

ICE may consider a spin-off or sale of NYSE's stock markets, a source told Reuters. As well as the 200-year old New York exchange, the NYSE also owns bourses in Paris, Amsterdam, Brussels and Lisbon.

"We can't exclude any option at this stage. It's all down to what regulators will require to get the deal approved, and to the timeframe they will give ICE to meet these targets," a source familiar with the situation told Reuters, adding that a deal was expected to be announced later on Thursday.

ICE has proposed buying NYSE, which also owns derivatives market Liffe, for $33 per share, a 37 percent premium to its Wednesday closing price, CNBC said.

One-third of the deal would be funded by cash and the rest in stock, the source confirmed.

NYSE and ICE representatives declined to comment.

Analysts said a deal would give Atlanta-based ICE a strategic boost with control of Liffe, Europe's second-largest derivatives market, helping it compete against U.S.-based CME Group Inc., owner of the Chicago Board of Trade.

"ICE is after Liffe, that is the crown jewel of NYSE Euronext. ICE could potentially sell the U.S. and European equities business, but could struggle to find a buyer. A spin-off of this business could be more likely," said Peter Lenardos, analyst at RBC Capital Markets.

"Strategically it makes sense for ICE to enter the European derivatives space in a meaningful way, but paying $10 billion -- with debt -- to do so sounds generous for NYSE shareholders and expensive for ICE shareholders.

At the close of trading on Wednesday, NYSE was worth about $5.8 billion, indicating that ICE may be willing to pay roughly $8 billion for the owner of the world's largest stock market.

NYSE shares jumped 12 percent in after-hours trading to $26.96. ICE shares rose 3.1 percent to $132.32.

REGULATORY THUMBS-UP

An ICE-NYSE Euronext tie-up would leap-frog Deutsche Boerse to become the world's third-largest exchange group with a combined market value of $15.2 billion. CME Group, ICE's largest U.S.-based rival, has a market value of $17.5 billion, Thomson Reuters data shows.

Hong Kong Exchanges and Clearing is the world's largest exchange group with a market capitalization of $19.5 billion.

ICE's main operations are in energy futures trading and unlike NYSE Euronext, it has steered clear of stocks and stock-options trading, so there is not much business overlap between the two groups, making it more likely competition authorities would approve a tie-up.

Last year, the U.S. Justice Department blocked a $11 billion joint hostile bid by ICE and Nasdaq OMX Group for NYSE Euronext on concerns the tie-up would dominate U.S. stock listings.

If that bid had succeeded, ICE planned to buy NYSE Euronext derivatives business while Nasdaq would have taken control of the stock exchanges.

A rival $9.3 billion bid by German exchange operator Deutsche Boerse also ran afoul of regulators.

"I doubt the competition authorities will have a problem with it, there's only a modest overlap between the businesses," said Richard Perrott, an analyst at Berenberg Bank.

"The rationale for the deal will be the same as that with Deutsche Boerse -- migrate the clearing of Liffe derivatives to ICE's services in London and scale up to attract OTC (Over The Counter) derivatives clearing. There could be more than $300 million in cost savings in the deal."

Before the latest ICE offer emerged, NYSE Euronext's shares had fallen by nearly a third since ICE and Nasdaq launched their thwarted joint bid.

The New York Stock Exchange, known as the Big Board and the symbol of U.S. capitalism, has seen its clout fade as new technology and the rise of private trading venues run by Wall Street banks and brokers cut its margins.

Founded in 2000 as a U.S. electricity trading platform backed by Wall Street banks and energy traders, ICE is the product of a string of acquisitions, from the London-based International Petroleum Exchange in 2001 through the New York Board of Trade and, most recently, a handful of smaller deals, including a climate exchange and a stake in a Brazilian clearing house.

Document shows CPS had detailed school closing plans









An internal Chicago Public Schools document obtained by the Tribune shows for the first time that the Emanuel administration has weighed how many elementary and high schools to close in which neighborhoods and how to manage the public fallout.


Labeled a "working draft," the Sept. 10 document lays out the costs and benefits of specific scenarios — revealing that the administration has gone further down the path of determining what schools to target than it has disclosed.


While schools are not listed by name, one section of the document contains a breakdown for closing or consolidating 95 schools, most on the West and South sides, as well as targeting other schools to be phased out gradually or to share their facilities with privately run charter schools.





Mayor Rahm Emanuel and his top school leaders have said they are in the early stages of making difficult decisions and that the city cannot afford to keep operating deteriorating schools with dwindling student populations in the face of a billion-dollar budget deficit. The document goes well beyond what the administration has outlined to the public.


Amid a September teachers strike, the Tribune reported that the Emanuel administration was considering plans to close 80 to 120 schools, most in poor minority neighborhoods. Administration officials have repeatedly denied they have such a figure.


"Unless my staff has a hidden drawer somewhere where they've got numbers in there, we don't have a number," schools CEO Barbara Byrd-Bennett said in November.


But the internal document, prepared at a time when school leaders faced a December deadline to make their decisions public, lays out multiple scenarios for closing neighborhood schools and adding privately run charters — a key component of Emanuel's plans for improving public education. Chicago Teachers Union members, aldermen and other charter school critics have accused the administration of favoring the charters while depriving schools in poor neighborhoods of needed improvements.


The document discusses how to deal with public reaction to school closing decisions, with ideas ranging from establishing "a meaningful engagement process with community members" to building a "monitoring mechanism to ensure nimble response to opposition to proposed school actions."


It is unclear how closely the administration is following the ideas in the 3-month-old document; sources told the Tribune the school closing plans are being constantly updated and subsequent proposals have been kept under close wraps.


The detailed document obtained by the Tribune comes from a time when a Chicago teachers strike interrupted the beginning of the school year and Jean-Claude Brizard was still Emanuel's schools chief; the embattled Brizard quit soon after. Byrd-Bennett was a top education official at CPS under Brizard and was named by Emanuel to succeed him.


CPS spokeswoman Becky Carroll said Tuesday that "this plan was proposed by past leadership at CPS and is not supported by CEO Byrd-Bennett."


"In terms of whatever document you have, I don't care when it's dated, as of today there's no list and there's no plan," Carroll said. "Maybe there were multiple, different scenarios passed around at some point, I don't know, but there's no list of schools.


"When CEO Barbara Byrd-Bennett took this position, she made it very clear that we were going to do this differently than how it's been done in the past," which is why she appointed a commission to take public input on school closings, Carroll said.


But under Byrd-Bennett's tenure, at least one of the proposals outlined in the secret document has come to pass — the idea of a five-year moratorium on further school closings after this school year.


First mention: The September document raises the idea of a moratorium that would extend beyond Emanuel's first term in office as part of the rollout of school closings. But the mayor's first public mention of a moratorium came in November, when he offered it as a sweetener that helped persuade state lawmakers to extend the December deadline for announcing school closings to March.


Critics called the delay a ploy to give opponents less time to organize against the closings. But Emanuel said school officials needed the time to gather community input on the "tough choices" about school closings.


Byrd-Bennett said her decisions on what schools to close won't come until after she receives recommendations from the commission she created. The Tribune reported last week that the commission chairman doesn't plan on issuing recommendations until days before the March 31 deadline for announcing school closings — and even then, there are no plans for the commission to identify individual schools.


While CPS has not released a list of schools to close, it has made publicly available a breakdown of how much a building is used, performance levels per school and how expensive the facility is to keep open. School officials have said underenrollment is a key factor in school closing decisions this year. The school system recently released a list of about 300 "underutilized" schools — nearly half the district — that have dwindling student populations.


But the document obtained by the Tribune contains clues as to how the administration could make those decisions.


Closing breakdown: The most stark page in the document is a graphic that breaks down the 95 schools that could be closed in each of CPS' 19 elementary and high school networks.

Facebook CEO Mark Zuckerberg donating $500 million in stock to Silicon Valley charity






SAN FRANCISCO – Facebook CEO Mark Zuckerberg said Tuesday he is donating nearly $ 500 million in stock to a Silicon Valley charity with the aim of funding health and education issues.


Zuckerberg donated 18 million Facebook shares, valued at $ 498.8 million based on their Tuesday closing price. The beneficiary is the Silicon Valley Community Foundation, a non-profit that works with donors to allocate their gifts.






This is Zuckerberg’s largest donation to date. He pledged $ 100 million in Facebook stock to Newark, New Jersey, public schools in 2010, before his company went public earlier this year. Later in 2010, he joined Giving Pledge, an effort led by Microsoft Corp. founder Bill Gates and Berkshire Hathaway Inc. CEO Warren Buffett to get the country’s richest people to donate most of their wealth. His wife, Priscilla Chan, joined with him.


In a Facebook post Tuesday, Zuckerberg, 28, said he’s “proud of the work” done by the foundation that his Newark donation launched, called Startup: Education, which has helped open charter schools, high schools and others.


With the latest contribution, he added, “we will look for areas in education and health to focus on next.” He did not give further details on what plans there may be for funds.


“Mark’s generous gift will change lives and inspire others in Silicon Valley and around the globe to give back and make the world a better place,” said Emmett D. Carson, CEO of the foundation.

LOS ANGELES (TheWrap.com) – “Les Miserables” director Tom Hooper and “Life of Pi” composer Mychael Danna are the latest awards-season hopefuls to be added to the slate of honorees at the Palm Springs International Film Festival, PSIFF organizers announced on Tuesday.


The two will join a list of honorees that in recent days has expanded to include Helen Mirren, Richard Gere, Bradley Cooper and Sally Field. Other awards will go to Helen Hunt, Naomi Watts, Robert Zemeckis and the cast of “Argo.”






Hooper will receive the Sonny Bono Visionary Award, named in honor of the singer/producer/actor and Palm Springs mayor who launched the festival. Past recipients include Danny Boyle, Quentin Tarantino, Baz Luhrmann and last year’s winner, “The Artist” director Michel Hazanavicius.


Tom Hooper brilliantly transforms the classic stage musical ‘Les Misérables’ into a cinema marvel,” said festival chairman Harold Matzner in a press release announcing the awards. “By asking his amazing cast of actors to sing live on film, Hooper allows them to connect even further with their characters, resulting in emotional powerhouse performances that are enthralling audiences worldwide.”


Danna, who has won acclaim for his score to Ang Lee’s “Life of Pi,” will receive the Frederick Loewe Award for Film Composing, a PSIFF honor that in the past has gone to T Bone Burnett, Alexandre Desplat, Danny Elfman, Randy Newman and Diane Warren.


Danna previously wrote music for Lee’s films “The Ice Storm” and “Ride With the Devil.” “Mychael Danna is a pioneer in creating original compositions that are as dramatic and innovative as the films in which they are featured,” said Matzner in the release.


PSIFF’s Awards Gala will take place on Saturday, January 5, and the festival will run from January 3 through January 14.

Irish Government Set to Allow Abortion in Rare Cases





DUBLIN — The Irish government said Tuesday that it was preparing to allow abortion under limited circumstances in an effort to comply with demands by the European Court of Human Rights to clarify the country’s legal position on the issue.

A vigil was held in Dublin on Monday in memory of Dr. Savita Halappanavar, a 31-year-old dentist who died after being denied an abortion.








The proposed legislative and regulatory changes would allow abortion only in cases where there is a real and substantial risk to a woman’s life — as distinct from her health.


The Supreme Court ruled in 1992 that abortion was permissible when risk was present, but the government never passed a law to that effect.


Addressing Parliament after the announcement, Prime Minister Enda Kenny was at pains to emphasize that the proposals would allow abortion only in certain cases. He added that the threat of suicide could be among them.


The abortion debate has convulsed Ireland for decades, but calls for change reached a crescendo after the death of Dr. Savita Halappanavar, a 31-year-old dentist, in October. Dr. Halappanavar arrived at a Galway hospital in severe pain and was found to be miscarrying. Her fetus had a heartbeat, making termination of the pregnancy illegal under Irish law. She died of septicemia a week after admission.

Property purchase near McCormick gets OK









Convention officials on Tuesday took a step toward acquiring properties north of McCormick Place for the potential development of hotels, restaurants and entertainment venues.


The Metropolitan Pier and Exposition Authority board approved the purchase of a parcel at 2101 S. Indiana Ave. for $5.1 million, with closing expected by year-end. A two-story building on the 23,126-square-foot property is now leased to operators of a methadone clinic.


The property is on the same block as a contested 1.23-acre parcel at 230 E. Cermak Rd., owned since 2005 by Olde Prairie Block Owner LLC. The company, led by developers Pamela Gleichman, Karl Norberg and Gunnar Falk, is fighting in U.S. Bankruptcy Court to retain that parcel as well as the entire block immediately to the east, at 330 E. Cermak, which it has owned since 1998 and hopes to develop as a convention hotel, a smaller boutique hotel and restaurants.





If Olde Prairie fails to show its plan is financially plausible at a hearing Dec. 27, Judge Jack Schmetterer has said he will dismiss it, opening the door for lender CenterPoint Properties Trust to take over the parcels and put them up for auction. Olde Prairie has been in default since early 2009.


Jim Reilly, CEO of the authority, the state-city agency that owns McCormick Place, declined to comment on whether the authority would pursue the Olde Prairie Block properties if they become available.


The authority, commonly known as McPier, has been in talks with DePaul University about the possibility of building an arena for men's basketball near McCormick Place, but Reilly said the purchase of the South Indiana parcel is an independent move aimed at ensuring the authority has room to develop such add-ons as more hotels, restaurants and entertainment venues. DePaul, whose Blue Demons play at the Allstate Arena in Rosemont, also has been in talks with the owners of the United Center.


Meanwhile, speculation has resurfaced about building a casino near McCormick Place, with questions about whether the Olde Prairie blocks would be considered. Reilly said he thinks they are too close to the exhibit halls. Convention officials have said a casino on the convention campus or its immediate vicinity could pull trade show attendees away from the show floor.


McPier's latest acquisition will add to a nearby parcel it already owns at 2100 S. Prairie Ave.


"Ultimately, our goal is to develop a more vibrant and interesting neighborhood for McCormick Place," Reilly said.


McPier will purchase the parcel on South Indiana from RZR Equities LLC, Noah LLC and Hinsdale 111 LLC.


A financial restructuring approved by the Illinois General Assembly in 2010 gave the authority additional borrowing capacity for expansion projects. McPier will use proceeds from expansion bonds to fund the purchase.

Students returning to classes in Newtown, Conn.









NEWTOWN, CONN. -- The schools of Newtown, which stood empty in the wake of a shooting rampage that took 26 of their own, are filled with the sounds of students and teachers this morning as the bucolic Connecticut town struggles to return to normal.


But among the normal sounds of a school day -- teachers reading to children, the scratch of pencil on paper -- students will hear new ones, including the murmur of grief counselors and the footsteps of police officers.

Four days after 20-year-old Adam Lanza strode into Sandy Hook Elementary school and gunned down a score of 6- and 7-year-olds, in addition to six faculty and staff, that school will remain closed. It is an active crime scene, with police coming and going past a line of 26 Christmas trees that visitors have decorated with ornaments, stuffed animals and balloons in the school colors of green and white as a memorial to the victims.


The massacre -- one of the deadliest school shootings in U.S. history, prompting some lawmakers to call for tighter restrictions on guns and causing school administrators around the country to assess their safety protocols.


Newtown police plan to have officers at the six schools that reopened Tuesday morNing, trying to offer a sense of security to the students and faculty, many of whom spent the weekend in mourning. Newtown Police Lieutenant George Sinko acknowledged it may be difficult to ease the worries of the roughly 4,700 returning students and their families.


"Obviously, there's going to be a lot of apprehension. We just had a horrific tragedy. We had babies sent to school that should be safe and they weren't," Sinko said. "You can't help but think ... if this could happen again."


Day for 'healing'


Newtown High School Principal Charles Dumais, in an e-mail to parents, said schools in the district would open two hours later than usual, with counselors available to students and their families.

"This is a day to start healing," Dumais said.


While school officials have not yet decided when Sandy Hook students will resume their studies, the building that they will move into - the unused Chalk Hill School in the nearby town of Monroe - already showed signs of preparation. On a fence opposite the building, a green sign with white lettering proclaimed "Welcome Sandy Hook Elementary!"Dan Capodicci, whose 10-year-old daughter attends the school at St. Rose of Lima Roman Catholic Church, said he thinks it's time for her to get back to classes.

"It's the right thing to do. You have to send your kids back. But at the same time I'm worried," he said. "We need to get back to normal."


Gina Wolfman said her daughters are going back to their seventh- and ninth-grade classrooms tomorrow. She thinks they are ready to be back with their friends.


"I think they want to be back with everyone and share," she said.


Newtown police Lt. George Sinko said whether to send children to school is a personal decision for every parent.


"I can't imagine what it must be like being a parent with a child that young, putting them on a school bus," Sinko said.


The district has made plans to send surviving Sandy Hook students to Chalk Hill, a former middle school in the neighboring town of Monroe. Sandy Hook desks that will fit the small students are being taken there, empty since town schools consolidated last year, and tradesmen are donating their services to get the school ready within a matter of days.


"These are innocent children that need to be put on the right path again," Monroe police Lt. Brian McCauley said.


With Sandy Hook Elementary still designated a crime scene, state police Lt. Paul Vance said it could be months before police turn the school back over to the district and complete their probe into Adam Lanza, who killed his mother, Nancy, athome, before driving to the school armed with a Bushmaster AR 15 rifle and two handguns. After shooting 26 people at the school, he turned his gun on himself when he heard police approaching.


First students laid to rest

Many of the students and faculty of Sandy Hook and its neighbors will still have funerals to attend.


On Monday, Newtown held the first two funerals of many the picturesque New England community of 27,000 people will face over the next few days, just as other towns are getting ready for the holidays. At least one funeral is planned for a student — 6-year-old Jessica Rekos — as well as several wakes, including one for teacher Victoria Soto, who has been hailed as a hero for sacrificing herself to save several students.

“The Office” head Greg Daniels sells tennis comedy to Fox






LOS ANGELES (TheWrap.com) – “The Office” might be preparing to close up shop, but the series’ creator is most definitely still open for business.


Greg Daniels, who birthed the American version of “The Office” – which is preparing to wrap up its run at the end of this season – has sold a half-hour comedy to Fox via Universal Television and his own Deedle-Dee Productions.






The project was sold through Daniels by Tom Gormican (“Are We Officially Dating?”) and Richie Keen (“It’s Always Sunny in Philadelphia”), who are also writing.


The as-yet-untitled project will revolve around Richie, a so-so tennis pro who returns to his college town to get a fresh start on life. There, Richie finds himself torn between living the carefree life with his bar-owning brother and growing up to pursue Kristen, the love of his life.


Daniels will executive-produce the project via his Deedle-Dee Production, along with Gormican and Keen.


Deedle-Dee’s Howard Klein and Tracy Katsky are also executive-producing, along with Oly Obst.

McDonald's urging franchisees to open on Christmas









McDonald's Corp. is urging U.S. restaurant owners to take the unusual step of opening on Christmas Day to deliver the world's biggest hamburger chain with the gift of higher December sales, AdvertisingAge reported Monday.

The request -- which comes as McDonald's tangles with resurgent rivals such as Wendy's, Burger King and Yum Brands' Taco Bell chain -- would be a break from company tradition of closing on major holidays.

"Starting with Thanksgiving, ensure your restaurants are open throughout the holidays," Jim Johannesen, chief operations officer for McDonald's USA, wrote in a Nov. 8 memo to franchisees -- one of two obtained by AdvertisingAge.

"Our largest holiday opportunity as a system is Christmas Day. Last year, (company-operated) restaurants that opened on Christmas averaged $5,500 in sales," Johannesen said.

"The decision to open our restaurants on Christmas is in the hands of our owner/operators," McDonald's spokeswoman Heather Oldani told Reuters.

Don Thompson took over as chief executive at McDonald's in July and has the difficult task of growing sales from last year's strong results in a significantly more competitive environment.

McDonald's monthly global sales at established restaurants fell for the first time in nine years in October, but unexpectedly rebounded in November.

The November surprise was partly due to a 2.5 percent rise in sales at U.S. restaurants open at least 13 months.

"Our November results were driven, in part, by our Thanksgiving Day performance," Johannesen wrote in a Dec. 12 memo to franchisees.

Oldani said 1,200 more McDonald's restaurants were open on Thanksgiving this year versus last year -- not 6,000 more as AdvertisingAge reported.

Still, the company has a high hurdle when it comes to posting an increase in restaurant sales this month because its U.S. same-restaurant sales jumped 9.8 percent in December 2011.

"It's an act of desperation. The franchisees are not happy," said Richard Adams, a former McDonald's franchisee who now advises the chain's owner/operators.

The push to open on the holidays goes against McDonald's cultural history, said Adams. In his first published operations manual, McDonald's Corp. founder Ray Kroc said the company would close on Thanksgiving and Christmas to give employees time with their families, Adams said.

"We opened for breakfast on Thanksgiving the last couple years I was a franchisee. It was easy to get kids to work on Thanksgiving because they want to get away from their family, but not on Christmas," Adams said.

The lack of snow set a new record this morning, but enjoy it while it lasts: Parts of the Midwest could see heavy snow on Thursday, and Chicago is unlikely to be spared.

A snowless Sunday means 2012 will set a new record for the latest date of first measurable snowfall in Chicago.

The previous record year was 1965 when it took until Dec. 16 for O'Hare International Airport to record at least one-tenth of an inch of snow, the National Weather Service's threshold for measurable snowfall.

This year's snowless streak is likely to end Thursday, when a low-pressure system currently over the eastern Pacific Ocean will reach the Midwest, said Mark Ratzer, a senior meteorologist with the National Weather Service in Romeoville.

Parts of the Midwest could see six to 12 inches of snow, and it remains unclear precisely what path the storm will take, Ratzer said.

Current models suggest the heaviest snowfall will land to the west of Chicago, from northern Missouri through eastern Iowa and up into Wisconsin, Ratzer said.

Depending on the storm's path, Chicago could get several inches or less than an inch, but it appears the city will get at least the tenth of an inch needed to record the season's first measurable snowfall, Ratzer said.
